Jomato and Param Foods had to face a strict decision of the Consumer Forum regarding an online food order in Gwalior. The Consumer Disputes Correspondence Commission ordered that the two companies should return to the consumer with Rs 342 with 6% interest and pay a compensation of Rs 10,000 for mental pain. Apart from this, the cost of fighting the case will also have to be paid 5 thousand rupees. If this amount is not given in 45 days, then additional 5 thousand rupees will have to be paid.
Online food order became the cause of trouble
Sandeep Kumar Richaria, a resident of Tikamgarh, ordered Paneer Tikka and Pizza from Param Foods in Gwalior on 9 February 2024 for his nephew’s birthday. For this order, he paid 342 rupees 11 paise online. The delivery was to be held in 30 minutes, but the pizza did not reach even after an hour. When he called the Jomato helpline, it was found that his order had been canceled, which was not reported to him. Neither the amount paid was returned.
Sandeep’s nephew’s birthday celebrations deteriorated due to lack of pizza. He lodged a complaint with the Consumer Forum against this fraud, after which the forum issued notice to Jomato and Param Foods.
Companies described themselves as innocent, but the forum convicted
Param Foods argued that they do not take direct orders, but accept booking only through Zomato. According to him, Jomato canceled the order and he was not even informed about it. So they are not responsible in this. On behalf of Jomato, it was said that they only do food delivery, they do not sell food themselves. He also stated that the order was canceled due to wrong address or restaurant problem.
However, after hearing the arguments of both the parties, the Consumer Forum found that there was a decrease in service and the consumer had to face mental anguish. On this basis, the forum ordered both Jomato and Param Foods to pay a total of Rs 15,342.
