Justice BR Gavai has once again expressed his displeasure over the situation in the Supreme Court. It is reported that he has described the Supreme Court as the most undisciplined place and compared it with the High Courts. Last year also he had raised questions on the Supreme Court on the issue of discipline. The special thing is that Justice Gavai is going to become CJI i.e. Chief Justice of India in May 2025.

Justice Gavai has praised the High Courts. Also there has been talk of noise in the Supreme Court. He said, ‘I have been a judge in Bombay, Nagpur and Aurangabad benches, but I have never seen indiscipline like the Supreme Court anywhere. Here we can see that 6 lawyers are sitting on one side, 6 lawyers are sitting on the other side and are shouting together. Never seen anything like this in the High Court.

Justice Gavai had made similar comments in September last year also. According to media reports, he had then expressed his displeasure at the lawyers who were continuously obstructing the debate. He had said, ‘For people like us, who come from the High Courts, this (Supreme Court) is the most undisciplined court. Anyone can speak from anywhere. There is a lot of indiscipline.

Current CJI Sanjeev Khanna is retiring on 13 May 2025. He took over the post after the retirement of Justice DY Chandrachud in November last year. After him, Justice Gavai is going to become CJI in May 2025. The special thing is that there can be other CJIs of the country, who come from the Scheduled Caste category. The Supreme Court got its first Dalit CJI in the form of Justice KG Balakrishna. He retired on 11 May 2010.
