The Supreme Court has ordered an FIR against former Delhi Police Commissioner Neeraj Kumar in a two -decade -old case. During the hearing in this case on Wednesday (September 10), the court said that those who investigate should also be investigated. The case is related to an 2001 incident when Neeraj Kumar was posted as Joint Director in CBI.
Neeraj Kumar was accused of forgery with documents in a case. The Supreme Court has ordered an officer to be investigated by an officer below the Special Cell and ACP rank of Delhi Police. Also, the court has directed to complete the investigation within three months. During the hearing, the court also underlined the basic principle of Nya which says that justice should not be Kev but should also be seen as justice.
‘Sometimes those who investigate should also be investigated’
The court said, ‘It would be an exaggeration to say that this crime was done in the year 2000 and till date it was not allowed to be investigated. If such a crime is not investigated, especially when the officers posted on deputation in the CBI are involved in this, then it will play with justice. It is mandatory in the law that justice should be done not only, but also to be seen. Now the time has come to investigate those who investigate sometimes to maintain the trust of the general public in the system.
Accused of disturbing and threatening documents
This case is related to an incident in 2001. During that time Neeraj Kumar was in the post of Joint Director in CBI. Neeraj Kumar and another officer are accused of threatening the documents of a case as well as threatening. The Supreme Court said that both officers will also have the right to participate in the investigation of the matter, so that they can prove that they have not committed any crime.
Special cell will investigate
Earlier, the Delhi High Court had upheld the order given in 2006 of its single bench to register an FIR against Neeraj Kumar and then CBI officer Vinod Kumar Pandey and rejected the appeals filed against it. This order of the High Court was challenged in the Supreme Court. Keeping the same order of the High Court, the Supreme Court ordered an officer to investigate the case below the Special Cell and ACP rank. A bench of Justice Pankaj Mithil and Justice PB Varlet said that it is the right time that those who investigate the investigation should also be investigated to maintain the trust of the general public in the system.
