The Allahabad High Court has directed the Home Secretary of the state to conduct an inquiry from the DCP Rank officer of the Arya Samaj Society of the state, which gives a certificate of marriage to the minor couple of opposite religion and has sought a compliance report. The next hearing of the petition will be on 29 August. The court did not consider the marriage of couples of opposite religion as a legitimate marriage without changing religion and said that it is a violation of the law.
The marriage certificate of a minor girl is being issued by violating the law in Arya Samaj temple. The court kidnapped a minor girl and refused to cancel the criminal case proceedings against the marriage in the Arya Samaj temple. This order has been given by a single bench of Justice Prashant Kumar on the petition of Sonu alias Sahanur.
Court issued summons on charge sheet
The petitioner said that an FIR was lodged against him on charges of kidnapping, rape and Paxo Act at Nichlaul police station in Maharajganj. The court has issued summons on the police charge sheet.
The petitioner has married the victim in the Arya Samaj temple, now he is adult and living together. Therefore, the proceedings of the case should be canceled.
Court sought affidavit from home secretary
The government advocate protested that both are of opposite religion. The marriage without conversion is illegal. The petitioner has not converted nor registered the marriage.
The court said that there have been many cases of fake wedding in Arya Samaj Societies and issuing marriage certificates to the minor. They are violating the law and issuing marriage certificates. It should be investigated and action should be taken. The court has sought a personal affidavit with the report from the Home Secretary.
