The Madhya Pradesh government is now going to implement the new tenancy Act in the state. Through this, important steps will be taken to preserve the rights of both the landlord and the tenant. The Urban Development and Housing Department has prepared the draft of the Act for this, which can be submitted in the monsoon session of the upcoming assembly. The act will now be applicable to urban areas as well as commercial and residential properties in rural areas.
According to the new bill, it will be mandatory for the tenant to vacate the house after the prescribed period in the contract. If he does not do so, the landlord can complain to the rent authority, after which the legal process of eviction will be started. However, in the event of a disaster, there will be no obligation to vacate the tenant, but he will have to pay the rent as per the contract.
Will not be able to keep a sub-class without a contract
Many times there are complaints that the tenant rents a house to someone else without telling the landlord. In order to do this in the proposed Act, it will be mandatory to take prior permission of the landlord. Even when the tenant does not vacate the house at the end of the contract, it will have to double for the first two months and then four times the fare.
Rules have also been made for landlord
Under the new law, the landlord will also not be able to harass the tenant unnecessarily. If the house is to be entered for repair or inspection, it will have to give information 24 hours in advance. Also, it will not disrupt essential services like water, electricity, pipe gas, lift, ladder lights, parking, sanitation and safety. The tenant will not be allowed to enter the premises without permission.
Rights to successor after tenant’s death
If the tenant dies, his successor will have the right to stay on rent, but he too will have to follow all the rules of the contract.
According to the Bill, rent tribunal will be set up in every district of the state. The deputy collector level officer will be made the rent authority, while the fare court will be the court of the additional collector. It will be mandatory to settle any complaint within 60 days. If the order is not followed, possession will be provided with the help of local bodies or police and action like attachment will also be possible.
Act will not apply to some complexes
This Act will not apply to premises under government campus, religious institutions, trusts or Waqf Board. At the same time, a dedicated online portal will also be developed to maintain the transparency of tenancy, where the contract information will be uploaded. Both the landlord and the tenant will have to give this information to the authority within two months.
