The ‘caste certificate’ of other states will be vulnerable in Madhya Pradesh, decision of High Court

The caste certificate issued from any other state cannot be used in Madhya Pradesh for the benefit related to that caste. Nor does he get any kind of eligibility in Madhya Pradesh on the basis of caste certificate of other state. The bench of MP High Court Justice Vivek Rusia gave this important verdict.

In the year 2015, the post of Ujjain Municipal Corporation Mayor was reserved for Scheduled Castes. Preeti Gehlod filed nomination for the post of Mayor here. He had imposed a certificate of scheduled caste class issued from Rajasthan with nomination. It was rejected by the Election Officer, invalidating his form. On this, he filed a petition in Ujjain District Court. The court rejected the election officer’s decision as correct. On this, Gehlod appealed in the High Court.

Will not get facility
It was argued that since Bairwa caste is in the Scheduled Castes in both Rajasthan and Madhya Pradesh states, it is a wrong decision not to accept their caste certificate correct. On this, on the basis of the order issued by the state government in 2014, the High Court agreed that the reservation facility will be available in the same state from where caste certificate was issued.

The state government has clarified that reservation facility will not be available in MP due to lack of caste certificate issued by MP. On this basis, the court justified the decision to dismiss the election petition.
