The Delhi High Court, while hearing a case, said that rape is one of the most heinous crimes against women, but some people use the law related to it as a weapon to unnecessarily harass their male partners. Along with this, the court canceled the FIR registered against a person. The man had approached the court requesting to cancel the FIR registered against him for sexually assaulting a woman he was in a relationship with. The court said that the FIR is based on ideas that came later.

The High Court said that it is clear from the recordings, WhatsApp chats and statements recorded before the magistrate that there was no evidence to prove rape. The man and woman had consensual physical relations. This relationship did not happen on the false promise of marriage. Justice Chandra Dhari Singh said that it is true that the provision under which the FIR has been lodged is one of the most heinous crimes against women. However, it is also an established fact that some people use it as a weapon to harass their male partner unnecessarily.

The court said that this case is a unique example of how an innocent person has to face undue hardship due to misuse of the penal provision. The court feels that even if the hearing of the case continues, nothing will come out. The counsel for the accused said that the petitioner and the complainant were earlier in a relationship. They had established consensual physical relations. The lawyer said that due to some differences, the accused and the complainant did not marry each other and later a case of rape was registered against the accused.
