The Supreme Court has issued necessary advisories regarding prevention of child marriage. After this, District Court Judge DP Sutrakar in Jabalpur, Madhya Pradesh has also issued instructions. In the advisory issued regarding Municipal Corporation and Jabalpur jurisdiction, it has been directed that before solemnizing the marriage, the priest will have to check the birth certificate of the bride and groom. Not only this, marriage garden and hotel operators will also have to do the same before booking for the wedding ceremony. If this is not done then a crime will be registered under the Child Marriage Prohibition Act.
The groom’s age should not be less than 21 and the bride’s age should not be less than 18 years.
It has been said in the advisory that taking the advisory issued by the Supreme Court seriously, the Madhya Pradesh High Court had given a copy of the advisory to all the magistrates of the state and ordered them to issue necessary guidelines.
Under Section 13 of the Child Marriage Prohibition Act-2006, instructions are issued that the marriage gardens, hotels and priests conducting marriages in the jurisdiction of Jabalpur Municipal Corporation should check the birth certificates of the bride and groom.
Do not solemnize the marriage if the age of the groom is 21 years and the age of the bride is less than 18 years. In case of violation of the advisory, the crime of conducting child marriage ritual will be registered on suo motu basis, which will be non-bailable.
Under its section 10, there is a provision of two years’ imprisonment and a fine of Rs 1 lakh. Orders have also been issued to implement the advisory with immediate effect. Necessary guidelines have also been issued to the Municipal Corporation in this regard.
Three years rigorous imprisonment to the husband who threatened and beat his wife
In another case related to crime, a husband resident of village Batoundha Tiraha under Shahpura police station of Dindori district has been sentenced to three years rigorous imprisonment for beating and threatening his wife. Media cell in-charge Manoj Kumar Verma said that in the year 2020, on the complaint of his wife, a case was registered against the accused husband Vikas Jain, father Pradeep Jain, age 40 years, resident of Bataundha Tiraha Shahpura.
While hearing the case of the accused doubting the character of his wife, abusing her and threatening to kill her, the Special Judge has awarded this punishment to Vikas Jain, accused under the SC/ST Prevention of Atrocities Act. It was told that the victim is posted as a staff nurse at Primary Health Center Kohani Deori. The dispute was filed by her husband on June 1, 2020. This matter was pending since the complaint.
