Madhya Pradesh High Court maintains ban on refilling old beer bottles


A beer company had complained about refilling of its bottles that other companies were filling their empty bottles with their product and putting their own brand labels. In this case, Madhya Pradesh High Court has maintained the ban on refilling old beer bottles.

Madhya Pradesh High Court has upheld the ban on refilling of old beer bottles, justifying the order of the Excise Commissioner. The case was heard before a double bench headed by Administrative Judge Sanjeev Sachdeva.

Which found the order of the single bench inappropriate and canceled it, in which provision for reconsideration was given. It was argued on behalf of the appellant beer company that the empty and old glass bottles of beer being manufactured by its company were being refilled by other companies. Not only this, labels of one’s own brand are also pasted on it.

Excise Commissioner had banned refilling of old bottles

After a factual complaint about this attitude, the Excise Commissioner had banned the refilling of old bottles. A petition was filed against this in the single bench. This was resolved with instructions that the Excise Commissioner should reconsider his order. The company challenged this order in the double bench through appeal.
