A case has come up in the District Consumer Commission, in which the builder had handed over the house with incomplete construction. The decision in this case has come, now the builder will have to return the said amount to the victim within two months, if it takes more time than this then nine percent interest will also have to be paid.

A consumer settled with a builder for Rs 20 lakh to build his dream house. The builder did not complete the house within the stipulated time. Also, the builder handed over the house with incomplete construction. The consumer complained about the matter to the District Consumer Commission. The Commission, through an engineer, got an estimate of the amount to be spent in completing the incomplete construction work. The engineer estimated the cost of completing the water work including electricity at Rs 3 lakh.

In fact, Piplani resident Nemichand Soni had filed a petition in the District Consumer Commission in 2019 against Arvind Kumar Gupta, proprietor of Saraswati Enterprises based in Avadhpuri. The bench of Commission Chairperson Giribala Singh, members Anjum Firoz and Preeti Mudgal gave the decision. The builder was ordered to pay an amount of Rs 3 lakh for the incomplete construction along with mental compensation amount of Rs 2 lakh and litigation expenses amount of Rs 5 thousand. If the builder does not return the amount of Rs 5.05 lakh within two months, then the amount will have to be paid with nine percent interest.

Consumer’s advocate Mona Paliwal said that the complaint was that a building was to be constructed on a plot located in Khajuri and given to the builder for Rs 20 lakh. The contract was signed on 30 September 2019 and the construction work of the building was to be completed in 10 months and handed over to the consumer. The consumer also paid the entire amount.

The builder did not complete the construction work of the house within the stipulated time. Electrical work was also not done in the building and the house was handed over to the consumer leaving many incomplete works. The consumer got upset and completed the construction work himself. Due to which he became mentally disturbed. While giving the decision, the Commission said that the builder has committed deficiency in service by not completing the contract within the time limit. For this reason compensation will have to be paid.
