For couples living in other countries, the Indore bench of MP High Court has given permission for hearing through video conferencing. Since then, the Family Court has started online hearing of such couples.

Giving relief to couples living abroad, the Indore bench of Madhya Pradesh High Court has allowed mediation and hearing in family disputes through video conferencing (VC). Now, despite the husband, wife or both living abroad, the Family Court will be able to hear and give verdict through VC in family disputes between them like divorce, maintenance etc.

The court has also started doing this. In fact, till now in such cases, personal presence of husband and wife in the court was mandatory. The mediation process and statements were recorded in their physical presence, but after the implementation of the Mediation Act 2023, petitions in this regard were presented in the High Court, resolving which the High Court conducted mediation and hearing through VC. Gave permission.

Case 1: America resident Sanam Mehta had filed a petition against his wife.

America resident Sanam Mehta had filed a petition for divorce against his wife in the Family Court, Indore. In this, he had requested for the mediation process to be conducted through VC, but the Family Court rejected the application. On this, Sanam presented a petition before the Indore bench of Madhya Pradesh High Court.

He told the High Court that after the implementation of the Arbitration Act 2023, arbitration and hearing can be done through VC. On this, the court ordered the family court to mediate through VC. Recently, through VC, an agreement was reached between both the parties regarding divorce by mutual consent. Sanam accepted to give Rs 28 thousand for lifelong maintenance of his wife.

Case-2: Wife living in America divorced her husband living in India.

The wife residing in America presented a petition in the family court for divorce from her husband residing in India on the basis of mutual consent. In this, citing the order of the High Court, he submitted an application for mediation through VC. The court accepted the application and ordered mediation. Presiding Officer Additional Chief Justice RK Jain got the mediation process completed.

Case-3: Wife in Canada and husband in America

The wife lives in Canada and the husband in America. Both wanted to divorce with mutual consent. His father, the common Mukhtyar appointed on his behalf, submitted a divorce petition under Section 13B of the Hindu Marriage Act in the Family Court through Advocate Amarsingh Rathore.

In the light of the High Court order, Advocate Rathore applied for mediation and hearing through VC. He told the court that both the parties want divorce by mutual consent and are ready for hearing through VC. Third Additional Chief Justice Maya Vishwa Lal, while accepting the application, ordered mediation through VC.
