Triple Talaq is dangerous for Muslim women, strict punishment is necessary; Centre tells SC


The Central Government has said in the Supreme Court that triple talaq is dangerous for the marital system in the society and it makes the condition of Muslim women miserable. The Central Government has given this argument in the Supreme Court by filing an affidavit. The Central Government said that even the Supreme Court’s 2017 order against triple talaq prevalent in the Muslim community is not able to reduce the cases of talaq. In such a situation, it is necessary to criminalize it.

The central government said that the victims of triple talaq have no other option but to go to the police. The police also used to be helpless in this case because due to the lack of provision of strict action in the law, it became difficult to take action against the accused husband. In fact, in a petition in the Supreme Court, it was said that when the court has declared triple talaq illegal, then there is no point in criminalizing it. Regarding this petition, the central government has presented its stand by filing an affidavit in the Supreme Court.

Actually, a petition was filed by Samasta Kerala Jamiatul Ulema earlier this month. This is an organization of Sunnis. The petitioner had called the Muslim Women (Protection of Rights after Marriage) Act 2019 unconstitutional. The petitioner says that this is a violation of fundamental rights. It cannot be declared a crime in any law on the basis of religion.

The central government rejected the petitioner’s claims and said that triple talaq violates the fundamental rights of women. Women have also been given equal rights in the constitution. The Parliament has unanimously made a law to protect the rights of women. It ensures gender justice and women’s right to equality. Let us tell you that the Supreme Court has already said that it does not want to discuss too much on the law made by the Parliament. The job of making laws is of the legislature and they should be allowed to do their work.
