Islamabad High Court, the capital of Pakistan, has given such a verdict which has launched a debate in the entire country. Judge Mohammad Azam Khan has allowed the 15 -year -old girl to live with her husband in his judgment.
The matter was related to the marriage of a minor girl and the court made a big statement on religious law and conflict of government law. In the judgment, a 15 -year -old girl has been allowed to live with her husband.
15 -year -old girl, marriage and court quarrel
This whole matter is related to a girl named Madiha Bibi. He is 15 years old in the record of Nadra i.e. Pakistan’s National Database Authority, but he was shown about 18 years old in Nikahnama. Madiha herself said in the court that she does not want to stay separate from her husband under any circumstances. Even when she was sent to the Crisis Center, she insisted the same- “I will live with my husband.”
According to Islamic Sharia, if the girl becomes an adult and marries on her own, then the marriage is considered valid. But Islamabad Child Marriage Restrant Act 2025 clearly says that marriage is a crime under 18 years of age. That is, religion is saying that marriage is right, on the other hand the law is calling it wrong.
Court’s decision of 24 pages
Justice Khan wrote in 24 pages, marriage is valid according to the Sharia, but the government law considers it a crime. The court also admitted that there is a big difference between religion and law on this issue. The court said that now the time has come to make all the laws related to marriage, minor and crime the same. Also, the Nikah Registrar was instructed not to register the marriage of boys and girls under 18 years of age under any circumstances.
The advice given to the government
In the verdict, the court gave several orders to the government
1. Nadra’s system should be so strong that the marriage certificate does not come out without confirmation of the right age.
2. A large -scale campaign should be run to make people aware of the loss and effect of child marriage.
3. This decision should be sent to Law and Justice Commission, Council of Islamic Ideology and many important government offices.
