Nirmala Sapre may not have accepted the record that she has taken membership of the BJP but has been continuously involved in the party’s programs. He had announced to join the party before the Chief Minister in a meeting held in Rahatgarh in Sagar district during the Lok Sabha elections but did not resign from the membership of the assembly.
The Congress Legislature Party has again approached the court to end the membership of Nirmala Sapre, who won the election on a Congress ticket from Bina assembly constituency of Sagar district. It has been challenged in the High Court Jabalpur under the Dal-Badal Act. In fact, Leader of Opposition in the Legislative Assembly Umang Singhar had filed a petition in the Indore bench of the High Court on the basis of Sapre’s announcement of joining BJP and being engaged in anti-party activities, in which the Speaker was made the basis for not taking action under the party law.
The Assembly Secretariat raised the matter of determination of jurisdiction, on which the petition was dismissed on the basis of not coming under the jurisdiction of Indore bench. On the basis of Nirmala Sapre’s anti-party activities, Leader of Opposition in the Assembly Umang Singhar had applied to Assembly Speaker Narendra Singh Tomar to take action under the Dal-Badal Act.
According to the rules, it should be resolved in 90 days but if the matter was drawn, then Singhar had filed a petition in the Indore bench of the High Court and requested to give directions. The Assembly Secretariat raised the matter of jurisdiction and requested to determine it first.
The High Court has now determined that the matter does not come under their jurisdiction. Secretariat officials say that Sapre is an MLA from Bina assembly seat in Sagar district, which comes under the jurisdiction of High Court Jabalpur. On the decision of the court, Singhar has now filed a petition in the High Court Jabalpur.

Action should be taken
Leader of Opposition Umang Singhar said that Sapre has made a team. She is coming to the BJP meetings, the evidence of which is available. Now it does not need to be stretched long. Under the Dal-Badal Act, their membership should be ended and should be banned from contesting elections for six years, but the BJP is saving them, because before this Ramnivas Rawat resigned and contested him by the by-election, in which he lost. The party is scared of this, so the episode should be complicated in the legal process.
