Allahabad HC reserved decision on Rahul Gandhi’s petition, case is related to Sikhs from America

The Allahabad High Court reserved its verdict after hearing a petition filed by Congress MP and Leader of Opposition in Lok Sabha on Wednesday. Rahul Gandhi has moved the High Court against the order of the Special Judge of Varanasi’s MP-MLA court.

After hearing the revision petition filed by Rahul Gandhi, Justice Sameer Jain reserved his decision and said that till the verdict is pronounced, the order of Special Judge (MP-MLA Court) will be stayed.

Rahul went to HC against court decision

The Special Judge of the MP-MLA Court had sent a petition related to the demand for filing an FIR against Rahul Gandhi to the ACJM Court to hear a fresh hearing against which the Congress leader turned to the Allahabad High Court. This case is related to a statement given in the US in 2024 last year.

A man named Nageshwar Mishra of Varanasi applied before the Additional Chief Judicial Magistrate (MP-MLA) of Varanasi, who rejected the application demanding an FIR against Rahul Gandhi after hearing the case on 28 November last year. The court then said that this speech was given in America, so this matter is outside their judicial region.

Where and what was the matter

Nageshwar Mishra challenged the revision court to dismiss the petition on behalf of the court, which accepted his revision petition and also directed the ACJM court to hear a fresh hearing in the case.

The case is from September last year. During a program in America, Congress leader Rahul Gandhi allegedly said that there is no good atmosphere for Sikhs in India. There was a lot of opposition in the country on his statement and it was described as inflammatory and divisive.

Nageshwar Mishra tried to register an FIR against Rahul’s statement at Sarnath police station in Varanasi, but he did not succeed there. After this, Nageshwar filed an application in the court for registering an FIR against Rahul. But the judicial magistrate dismissed this petition. On November 28, 2024, the court rejected his application, saying that since the matter is related to the speech given in America, it is out of his judicial region.

After the petition was dismissed, Nageshwar, a resident of Varanasi, filed a revision petition in the sessions court, which was accepted by the court on July 21 this year. However, Rahul Gandhi filed a revision petition against this decision in the Allahabad High Court, in which it was argued that the court order of Varanasi is wrong, illegal and out of its judicial area.
