The Bombay High Court dismissed a woman’s petition, in which she challenged the family court order. The court said that it is cruelty for the wife to deny physical relationship with her husband and suspect of love affair. The High Court said that the husband’s behavior has caused mental pain to the husband and there is no possibility of this marriage to improve.
Many such cases of divorce are coming up all over the country, on which various arguments are made. The Bombay High Court has given a big verdict. The court has rejected the wife petition. Keeping the divorce order, the court has also rejected the woman’s demand for monthly maintenance of Rs 1 lakh.
Pressure cruelty for physical relationship- Court
The Bombay High Court admitted that it is not wrong to refuse the husband’s body after marriage. However, it is cruelty to suspect him of love affair for this. Justice Revathi Mohit Dera and a bench of Neela Gokhale said on Thursday that the conduct of the woman can be considered as “cruelty” towards her husband.
The court dismissed the woman’s plea in which she challenged the order of the family court in which the husband’s divorce petition was accepted. The woman had also demanded to give instructions to give her husband a monthly alimony of Rs 1 lakh.
High court pronounced decision in favor of husband
The couple was married in 2013, but in December 2014 they started living separately. In 2015, the man approached the Pune family court for divorce on the basis of cruelty, which was approved. The woman said in her petition that her in -laws had harassed her, but she still loves her husband and so she does not want to end the marriage.
However, the husband claimed cruelty on several grounds, which includes refusing physical relationships, suspecting him to have a extramarital affair and embarrassing him in front of his family, friends and employees.
The court said that the woman’s husband’s indifferent and indifferent behavior with her husband’s disabled sister will definitely hurt her and her family members. The court dismissed the woman’s petition and said that the marriage between the couple has been broken and there is no possibility of improvement.
