All other nursing cases along with the public interest litigation of the Law Students Association in the fake case in the recognition of nursing colleges were held in front of Justice Sanjay Dwivedi and Justice Achal Kumar Paliwal in the Special Bench of the High Court, in which the Registrar and MP Nursing Council of the Indian Nursing Council has ordered the Registrar and Chairman of the Nursing Council to be held in the High Court.
During the hearing, the petitioner presented the application to the court that despite the High Court giving orders three times, the responsible officers of the Indian Nursing Council and the MP Nursing Council are not presenting the full records related to the recognition, alleging that they are constantly disregarding the order of the High Court with the aim of saving the culprits, due to which the proceedings against them should be started.
Council responsible officials instructions to appear in next hearing
The High Court made a strong comment in this case, saying that not to comply with the order of the High Court and do not present the records, it is like an attempt to save the culprits, interfering in the judicial proceedings, so the responsible officials of the council will have to appear before the High Court in the next hearing and clarify in the case as to why the High Court order was not followed?
Question on the role of a committee constituted on HC’s instructions
The petitioner submitted another application to the High Court that students of 30 ineligible colleges have been transferred to other colleges by the High Court committee constituted by the High Court for nursing matters and no transparent procedure has been adopted and neither students were given the option of choosing favorite colleges.
Order to submit the report of final proceedings to the High Court by 31 May
In this case, the High Court has ordered the Nursing Council to transfer students of all unsuccessful colleges in transparent ways to choose the option in a transparent manner, and the nodal officer should be kept away from this whole process. The High Court has also ordered that since the work has been completed by the High Court to the committee, now the committee will have to submit the report of the final proceedings to the High Court by May 31.
