The Madhya Pradesh government is constantly being tightened by the illegal colony. The municipal act will soon be changed by the state government and a strict law will be enacted for illegal colony. According to the new law, if an illegal colony is formed, it will be sentenced to 10 years as well as a fine of up to Rs 50.

Urban Administration Minister Kailash Vijayvargiya gave information in this regard and said that this law will be affected from this month. With this, all the illegal colonies before 2016 will be legalized. However, the government has not yet taken its final decision on this.

Consider to legalize illegal colonies before 2016
The Mohan government is considering legalizing illegal colonies made before 2016. In fact, with the change in the provisions of punishment and fine in the existing law of regularizing illegal colonies, it is also being decided to legalize colonies made before 2016 or before 2022. There is no clear consent on this yet. However, last year, the Urban Administration Minister reviewed the illegal colonies and sought data from the district collectors till 2016, which is estimated that the government can regularize the colonies made before 2016. Let us know that the former CM of MP had decided to regularize illegal colonies made before 2022. It was announced before the assembly elections 2023.

First, know what decision the Shivraj government had taken, during the tenure of former CM Shivraj Singh Chauhan, it was decided to legalize illegal colonies made before 2016. Subsequently, while announcing at the program organized for regularization of illegal colonies on 23 May 2023 just before the assembly elections, Shivraj decided to regularize all the illegal colonies made by December 2022. Was also announced not to take any development fee.

Shivraj said-

I believe that when these colonies were being built, it should have been noted whether she is becoming valid or illegal. But what is the fault of our siblings? Bought a plot by planting capital for a lifetime. A house was built by adding pie and pie. The house was built, then the government came and said- it is illegal. This is not justice. Illegal meaning did we become criminals? The decision to justify illegal is illegal, I end this decision.

Now know why the current government is amending the law, Madhya Pradesh government Has made a law to legalize illegal colonies but has not been easily followed. The Shivraj government had decided to legalize illegal colonies made before 2016. At that time, the Urban Administration and Housing Department had surveyed 607 such illegal colonies by surveying the entire state.

When the Mohan government ordered data of illegal colonies from the districts last year, it was found that the number of illegal colonies has increased from 6077 to 7981 i.e. 1908 new illegal colonies have been formed. Urban Development and Housing Minister Kailash Vijayvargiya had said in the last session of the assembly that the government will not legalize the illegal colonies being constructed in the state. People living in these can get basic facilities, get building permission, this work is being done.

He also said that illegal colonies have become a serious issue in the state. The law will be brought soon for this. Explain that under the sub -sections of Section 292 and 339 of MP Municipal Act 2021, there is a provision of punishment and fine against those who make illegal colony.

Understand from the example of Bhopal, how the illegal colonies growing last In two years, 300 new illegal colonies have been cut in Bhopal. According to the survey conducted in 2022, a total of 576 illegal colonies were found in Bhopal district. Of these, 321 colonies made before 31 December 2016 were placed in the category of regulation. An FIR was lodged by December 2023 at the remaining 255.

Now, if the survey has been started from fresh, more than 300 new illegal colonies have been found. This survey is still going on, so their number may increase. Please tell that before the year 2000, there were 198 illegal colonies in Bhopal. It was mentioned in the then survey report of the Municipal Corporation, that is, in 25 years, such colonies have increased by three times.

Illegal Colonizer: 10 years sentence, 50 lakh fine

The proposed amendment has also placed a firm, company, society, institution, promoter or government unit in the colonizer category with the person.

Earlier a colonizer was registered in a district, but in the proposed amendment, registration will now be done at the state level. For this, the government will appoint a registration authority. After this, the colony will be able to cut the colony in any part of the state.

The colonizer will apply to the competent officer as before to build the colony. However, the proposed amendment provides for fixing the time limit for permission to allow the colony. If the officer does not inform the colonizer about permission or not to give permission in the scheduled time, then permission will be considered.

There is a provision for a sentence of three to 7 years and a fine of Rs 10 lakh against the colonizer without permission. In the proposed amendment, it is being fined 7 to 10 years and 50 lakhs.

Due to lack of concrete action against illegal colonies, their number is increasing day by day. The proposed amendment has also decided that action should be taken against illegal colonies formed after July 2021. The money spent to break the illegal construction should be recovered from the colonizer.

Councilors will be able to complain about municipal corporation and family officials

According to the proposed amendment, if an officer of the Municipal Corporation or Municipality-Council who has the responsibility of stopping illegal construction does not fulfill his responsibility or does not try to stop it, then a three-year sentence and a fine of 10,000 have been provided.

A provision has also been added to register an FIR against the illegal colonizer within 90 days after receiving the complaint from the police. If the police officers do not follow the limits this time, then a provision has been made for disciplinary action against them.

Till now only farmers and buyers were nominated in cases of illegal colonies, which saved colonizers from legal action. But in the new draft, the promoters and those who provoke an illegal colony will also be made accused. Which will tighten legal grip on illegal colonizers.

According to the proposed amendment, councilors of the ward can also inform the Collector, Chief Municipal Officer or Engineer about the illegal colony. They will have to give this information in writing.
