High court accepted cruelty, divorce application for drinking alcohol and being irresponsible to family

The High Court has considered mental and physical cruelty towards wife and family to be habit of drinking excessive alcohol in Bilaspur and irresponsible towards family. The court has accepted the wife’s divorce plea, dissolving the marriage.

The woman, a resident of Janjgir Champa district, was married on 7 June 1991. The petitioner was studying at the time of marriage and she wanted to continue studying even after marriage. The husband and his family started protesting and tortured him. The husband was harassing her otherwise including excessive drinking. Even after the birth of children, there was no change in husband’s behavior. The woman is working as a teacher to run the house. For 29 years of marriage, the wife made every effort to save the family. Even after this, the wife started living separately from her husband with children when there was no improvement.

The wife applied for divorce in the Janjgir family court. On rejecting the application from the Family Court, he submitted an appeal in the High Court and said that the husband does not do any work and has a habit of drinking excessive alcohol. Apart from this, there is an illicit relationship with other women of the village. The house is assaulted and abused. Today, Justice Rajni Dubey and Justice NK Vyas heard an appeal in DB. The allegation made by his wife on behalf of the defendant husband was not denied.

After listening to all the parties, the court said in his order that if the husband does not discharge his responsibility, the family situation worsens. This is naturally mental cruelty to the wife. The whole family is facing social infamy due to irresponsible and Ayyash husband’s conduct. Therefore, the wife is entitled to divorce. Two witnesses appeared on behalf of the appellant wife. It also has a adult daughter in it. The daughter informed the father about the mother and the cruel behavior being done to her and said that the mother and she herself do not want to live with the father. The court has considered this testimony of the daughter to be important.
