Allahabad High Court judge Justice Shekhar Kumar Yadav is embroiled in controversies after giving the statement that ‘the country will run according to the majority’. After the uproar, the Supreme Court has taken major action on the matter. SC Collegium has summoned Justice Shekhar Kumar Yadav to appear in the Supreme Court. Justice Shekhar Kumar Yadav has also been asked to clarify his controversial statement. It is noteworthy that Justice Shekhar Kumar Yadav had given a controversial statement in a program organized by the Legal Cell of Vishwa Hindu Parishad. He had said that the law of the country will run according to the wishes of the majority.
India Today, quoting sources, said that the collegium headed by the country’s Chief Justice Sanjiv Khanna will soon hear the matter. According to reports, the Supreme Court will discuss this matter before the winter vacation of the apex court i.e. December 17. Earlier on December 10, the Supreme Court had sought a report from the Allahabad High Court citing media reports related to the statement. An official statement from the top court said, “The Supreme Court has taken cognizance of the reports of the speech given by Justice Shekhar Kumar Yadav, a sitting judge of the Allahabad High Court. Other details have also been sought from the High Court and the matter is under consideration.”
Speaking at a Vishwa Hindu Parishad (VHP) event in Prayagraj on December 8, Justice Yadav, speaking at the Uniform Civil Code, said, “This is the law. The law actually works according to the majority. Look at it in the context of family or society. Only that which brings happiness and benefits to the majority will be accepted.” There was a lot of uproar regarding this statement on social media. Opposition leaders had described the judge’s remarks as divisive and unconstitutional.
People associated with the legal world had also raised serious questions on this. Senior advocate Prashant Bhushan and CPI(M) leader Vrinda Karat had written a letter to Chief Justice Sanjiv Khanna saying that this comment was a violation of the oath of office of the judge. The Bar Association of India had also passed a resolution condemning this comment. Meanwhile, 55 opposition MPs had filed a notice in the Rajya Sabha last Friday demanding impeachment against Justice Shekhar Yadav.
